Mandate:
Section 78 (1) and (2) of the Police Act #38 of 1966 confers on the police the authority to lay any information or make a complaint before a magistrate in the name of the Chief of Police and for any other police officer to appear and prosecute the matter. Vested with the command and superintendence of the Royal Grenada Police Force via section 7 of the Act, the Chief of Police has delegated the effective and efficient application of this section to the Prosecution Department. 
 
The department has a three (3) dimensional structure: Administration, Prosecutorial and Process Service.
Administration:  
Responsibilities
  • Case file management which includes the maintenance of a dual system of registers  
  • Supports operational efficiency and accountability
  • Recording and tracking of warrants and summons received from the magistrate’s courts and accounting for fines collected from the execution of warrants
Prosecutorial Unit:
Responsibilities:
  • Reviewing of summary, indictable and traffic case files for sufficiency of evidence before they are lodged with the Magistrate courts.
  • The Prosecution of all summary criminal and traffic cases before the island’s nine (9) Magistrate Courts. Slightly under ninety-five percent (95%) of all cases prosecuted result in convictions.
  • Leading evidence in indictable cases at the Preliminary Inquiries stage to establish a prima facie case before these cases can be sent to the Supreme / High Court for trial.
  • Adducing evidence or information before the coroner in Inquest hearings.
 
The Process Unit:
Responsibilities:
  • Service of all traffic and criminal summons issued by the nine (9) magistrate courts.
  • The execution of the warrants issued by these courts including Bench, Conviction, Commitment and Judgement Debtors (JDS) Warrants.
